NexTurn Terms of service

Terms of service

The agreement between you and NexTurn for using NexTurn. By making an account or using the service, you agree to these terms. Questions go to [email protected].

1. The service

NexTurn, the operator of nexturncre.com ("NexTurn", "we", "us"), provides the NexTurn CRM at crm.nexturncre.com (NexTurn for brokers and NexTurn for hotel owners), deal rooms and listing pages, the NexTurn API and AI connector at api.nexturncre.com, the market data in them, and this website (together, "the service"). If you use the service for a company, you agree to these terms for that company, and "you" means both of you.

2. Your account and workspace

  • You must be 18 or older and give accurate information when you sign up.
  • Keep your sign-in to yourself. You are responsible for what is done with your account. Tell us at once if you think someone else has used it.
  • A workspace belongs to its owner. The owner and co-owners decide who is invited, what each member can do, and whether each member may connect an AI assistant. When you are removed from a workspace, your access to its records ends; the records stay with the workspace.

3. Your data

What you and your workspace put into NexTurn (contacts, companies, properties, notes, documents, photos, financials, listings and the rest) stays yours. You give NexTurn permission to store, copy, process and show it only as needed to provide the service to you and the people you share it with, and to keep it safe. How we handle personal information is in our privacy policy.

You are responsible for your data and for having the right to put it in NexTurn and use it: for example, the right to hold your contacts' details, to email the people you email, and to advertise the properties you list. When you use NexTurn to contact people, you follow the laws that apply, such as those on marketing email, calls and texts.

A workspace's owners and co-owners can export its records at any time. If you or we end your use of the service, the owner can export the workspace for 30 days afterwards, unless the law prevents it.

4. Market data and estimates

NexTurn shows information gathered from public records and public websites: parcels and owners of record, sales, listings and auctions, taxes, hotel rates and reviews, local events, and estimates worked out from them, such as demand from events. It is collected automatically and may be incomplete, out of date or wrong. It is provided for information only. It is not an appraisal, a valuation, or investment, legal, tax or financial advice. Check anything important against its source before you rely on it.

5. Deal rooms and listings

  • Brokers and sellers who publish a listing or deal room confirm they have the right to advertise the property and to share its documents and photos, and are responsible for what the listing says and for the confidentiality agreement they ask buyers to accept.
  • Buyers and their brokers who make an account agree to the listing's confidentiality agreement before its documents open, and understand that the listing's broker team sees their name, contact details, and the pages and documents they view and download.
  • NexTurn provides the software. It is not a party to any transaction, offer or agreement between buyers, sellers and brokers, and does not act as anyone's broker through the service.

6. Accounts and AI assistants you connect

You can connect accounts with other services, such as Gmail, Google Calendar, Outlook, Constant Contact, and your own Claude or ChatGPT. You allow NexTurn to use each one as its feature describes, and you can disconnect it at any time. Those services are run by others under their own terms, which apply to your use of them. NexTurn is not responsible for them, and a feature that depends on one may stop working if that service changes or ends it.

An AI assistant you connect acts on your instructions, with your access. You are responsible for what you ask it to do and for checking the changes it makes. NexTurn keeps each change in the record's change log, and a deleted record can be put back for 90 days.

7. Acceptable use

Don't use the service to:

  • break the law or anyone's rights, including privacy and intellectual property rights;
  • send spam or unwanted marketing, or harass anyone;
  • upload malware, or anything you don't have the right to share;
  • get into accounts, workspaces or data that aren't yours, or test, probe or get around NexTurn's security or limits;
  • copy the service's data in bulk with bots, scrapers or scripts outside the export and the AI connector NexTurn provides, or resell it;
  • overload the service or interfere with other people's use of it;
  • copy, take apart or rebuild the service's software, except as the law allows.

We may limit how fast anyone uses the service and refuse requests that break these rules.

8. Price

NexTurn for brokers and NexTurn for hotel owners are free today. If we offer paid plans, we will say what they cost before you choose one, and nothing is charged without your agreement. Payments, when there are any, are handled by Stripe.

9. NexTurn's service

The service, its software, design and market data are NexTurn's or its licensors', and these terms give you the right to use them while you use the service, not to own them. Your data stays yours (section 3). If you send us ideas or feedback, we may use them without owing you anything.

10. Changes, suspension and ending

We improve the service often, and may add, change or remove features. We will tell you in advance of a change that takes away something important you rely on, when we can. You can stop using the service at any time. We may suspend or end your access if you break these terms, if it is needed to protect the service or other people, or if the law requires it; when we can, we will tell you first and give you the chance to export (section 3).

11. Disclaimer

The service is provided "as is" and "as available". To the extent the law allows, NexTurn makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and does not promise that the service will be uninterrupted or error-free or that data in it will be complete or correct.

12. Limit of liability

To the extent the law allows, NexTurn is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from the service or these terms, even if told they were possible. NexTurn's total liability for all claims about the service or these terms is limited to the greater of what you paid NexTurn for the service in the 12 months before the claim, or $100. Some places don't allow these limits, so they may not all apply to you.

13. Your responsibility to us

If someone makes a claim against NexTurn because of your data, your use of the service, or your breaking these terms or the law, you will cover NexTurn's reasonable costs of it, including reasonable lawyers' fees.

14. Governing law

These terms are governed by the laws of the State of Minnesota, without its conflict-of-laws rules. Any dispute about them or the service will be decided in the state or federal courts in Hennepin County, Minnesota, and you and NexTurn agree to those courts. Before going to court, write to us and we will try to settle it with you in good faith.

15. Everything else

These terms and the privacy policy are the whole agreement between you and NexTurn about the service. If part of them can't be enforced, the rest still applies. Not enforcing a part right away doesn't waive it. You may not transfer these terms without our agreement; we may transfer them as part of a merger or sale of NexTurn. When we change these terms we update the date at the top, and we tell you by email or in NexTurn before a change that matters takes effect; using the service after that means you accept the change.
